The following terms and conditions regulate the legally different types of arrangement of travel services and package tours with regard to the rights and obligations of the customer and the agent depending on the type of travel service. A distinction must then be made between
a) the arrangement of a package tour, hereinafter referred to as "travel agency", the agent in this context "travel agent"; you will find the regulations in section A of these terms and conditions.
b) brokering related travel services; you will find the regulations in section B of these terms and conditions.
c) the arrangement of a single travel service; you will find the regulations in section C of these terms and conditions.
Section D contains the terms and conditions that apply equally to all types of services.
Regulations for the travel brokerage of package tours acc. § 651v BGB
The provisions of this section A on the travel brokerage of package travel contracts apply if Maurer & Steingruber GbR (Big 5 Africa Tours) hands over the form on package tours. In the form, the brokered tour operator is identified as the entrepreneur responsible for providing the package tour.
1. Conclusion of contract, statutory provisions
1.1. When Maurer & Steingruber GbR (Big 5 Africa Tours) accepts the customer's arrangement order, the contract for the travel agency of a package tour is concluded between the customer and Maurer & Steingruber GbR (Big 5 Africa Tours) as the travel agent. Order and acceptance do not require a specific form. If the order is placed electronically (e-mail, internet, online booking form, fax, messenger services), Maurer & Steingruber GbR (Big 5 Africa Tours) confirms receipt of the order electronically. This confirmation of receipt does not yet constitute a confirmation of acceptance of the travel agency order.
1.2. The mutual rights and obligations of the customer and Maurer & Steingruber GbR (Big 5 Africa Tours) as a travel agent arise, unless there are mandatory legal provisions to the contrary, from the individual contractual agreements, these terms and conditions and the legal provisions, in particular §§ 651a ff BGB in conjunction with Art. 250ff. EGBGB and §§ 675, 631 ff. BGB on the paid agency.
1.3. The agreements made with the tour operator apply exclusively to the rights and obligations of the customer towards the brokered tour operator, in particular - if effectively agreed - its travel or business conditions. Without a special agreement or without special notice, the transport conditions and tariff regulations issued on a legal basis by the responsible transport authority or on the basis of international agreements apply to transport services.
2. Payments, declarations from customers
2.1. Travel agents and tour operators may only request or accept payments on the travel price before the end of the package tour if the tour operator has an effective customer money protection contract and the customer has been given the security certificate with the name and contact details of the customer money insurer in a clear, understandable and highlighted manner.
2.2. Maurer & Steingruber GbR (Big 5 Africa Tours) is generally not considered to be authorized by the tour operator to receive notifications of defects and other declarations from the customer / traveler regarding the provision of the package tour. Maurer & Steingruber GbR (Big 5 Africa Tours) will, however, immediately inform the tour operator of such declarations by the traveler. Maurer & Steingruber GbR (Big 5 Africa Tours) recommends to avoid loss of time, despite immediate forwarding, to make relevant statements directly to the tour guide or the contact point of the tour operator.
3. General contractual obligations of the travel agent, information, notices
3.1. The customer will receive the best possible advice on the basis of these brokerage conditions. Upon request, the booking request can then be made with the package tour operator by Maurer & Steingruber GbR (Big 5 Africa Tours). After confirmation by the package tour operator, the obligation to perform includes the handover of the documents on the travel service (s) arranged. This does not apply if it has been agreed that the package tour operator will send the documents directly to the customer.
3.2. When issuing other instructions and information that the travel agent is not required to provide in accordance with Section 651v Paragraph 1 BGB in conjunction with Art. 250 § 1 to 3 EGBGB, Maurer & Steingruber GbR (Big 5 Africa Tours) is liable within the framework of the law and the contractual agreements for the correct selection of the information source and the correct transfer to the customer. An information contract with a main contractual obligation to provide information is only concluded with a corresponding express agreement. Maurer & Steingruber GbR (Big 5 Africa Tours) is not liable for the correctness of the information provided in accordance with Section 675 (2) BGB, unless a special information contract has been concluded.
3.3. Without an express agreement, Maurer & Steingruber GbR (Big 5 Africa Tours) is not obliged to determine and / or offer the cheapest provider of the requested travel service. The travel agent's contractual obligations within the framework of the "best price guarantees" issued by him remain unaffected.
3.4. Without express agreement, Maurer & Steingruber GbR (Big 5 Africa Tours) does not guarantee any information on prices, services, booking conditions and other circumstances of the travel service within the meaning of the of Section 276, Paragraph 1, Clause 1 of the German Civil Code (BGB) and with regard to information about the availability of the services to be mediated by the travel agent, there is no procurement guarantee within the meaning of this provision.
3.5. Maurer & Steingruber GbR (Big 5 Africa Tours) only accepts special requests for forwarding to the package tour operator to be mediated. Unless otherwise expressly agreed, Maurer & Steingruber GbR (Big 5 Africa Tours) is not responsible for fulfilling such special requests. These are also not a condition or contractual basis for the brokerage order or for the customer's booking declaration to be transmitted by the travel agent to the package tour operator. The customer's attention is drawn to the fact that special requests usually only become part of the contractual obligations of the package tour operator with the express confirmation of the package tour operator.
4. Obligations of the travel agent in the event of complaints by the customer towards the brokered package tour operators
The customer can also notify the travel agent through whom he has booked the package tour that he has notifications of defects and other declarations regarding the provision of the travel services by the package tour operator. The ads will be redirected. However, the customer is expressly advised that the notification of defects must generally be sent directly to the package tour operator. With regard to any claims of the customer against the brokered package tour operators, the travel agent is not obliged to advise on the type, scope, amount.
Regulations for the arrangement of related travel services in accordance with Section 651w BGB.
The provisions of this Part B on the arrangement of connected travel services are applicable if Maurer & Steingruber GbR (Big 5 Africa Tours) hands over the form on the arrangement of connected travel services. In this form, the customer is informed that booking a further travel service with Maurer & Steingruber GbR (Big 5 Africa Tours) does not book a package tour, but that a related travel service can be arranged.

2. Payments
2.1 The broker of connected travel services may only accept payments from the traveller for remuneration for travel services if he has ensured that these will be reimbursed to the traveller insofar as travel services are to be provided by the broker himself or remuneration claims of mediated service providers have to be met and in the event of insolvency of the intermediary of related travel services.

b) the traveller complies with requests for payment from unsatisfied mediated service providers with regard to travel services provided.
2.2 The agent of related travel services provides this security when arranging related travel services by taking out insolvency insurance in accordance with Section 651w (3) of the German Civil Code (BGB), stating the name and contact details of the customer money insurer in a clear, understandable and highlighted manner and handing over a corresponding security certificate for all payments made by the customer to the intermediary of related travel services, unless the customer directly contacts the intermediary of the affiliated service provider Travel service.

When giving advice and information, Maurer & Steingruber GbR (Big 5 Africa Tours) is liable within the framework of the law and the contractual agreements for the correct selection of the information source and the correct transfer to the customer. An information contract with a main contractual obligation to provide information is only concluded with a corresponding express agreement. According to Section 675 (2) of the German Civil Code, the agent is not liable for the correctness of the information provided, unless a special information contract has been concluded.
3.3. Without an express agreement, the agent is not obliged to determine and / or offer the cheapest provider of the requested travel service. Contractual obligations of the agent within the framework of the "best price guarantees" issued by him remain unaffected.
3.4. Without express agreement, Maurer & Steingruber GbR (Big 5 Africa Tours) does not guarantee any information on prices, services, booking conditions and other circumstances of the travel service within the meaning of the of § 276 Paragraph 1 Clause 1 BGB and regarding. Information about the availability of the services to be mediated by the agent does not constitute a procurement guarantee within the meaning of this provision.
3.5. Maurer & Steingruber GbR (Big 5 Africa Tours) only accepts special requests for forwarding to the service provider to be mediated. Unless otherwise expressly agreed, Maurer & Steingruber GbR (Big 5 Africa Tours) is not responsible for fulfilling such special requests. These are also not a condition or contractual basis for the brokerage order or for the customer's booking declaration to be sent by the broker to the service provider. The customer's attention is drawn to the fact that special requests can usually only be made by the service provider expressly confirming the content of the service provider's contractual obligations.
4. Obligations of the agent in the event of complaints by the customer towards the mediated service providers
4.1. Claims must be asserted against the mediated service providers within certain deadlines, which may result from the law or contractual agreements. As a rule, these deadlines are not met by asserting them against Maurer & Steingruber GbR (Big 5 Africa Tours). This also applies if the customer wishes to assert claims against both the agent and the service provider with regard to the same travel service.
4.2. In the event of complaints or other assertion of claims against the mediated service providers, the agent's duty is limited to providing the information and documents required and known to him, in particular the notification of the names and addresses of the mediated service providers.
4.3. If the agent takes over the forwarding of the customer's letters of claim within the deadline - even without being obliged to do so - he is only liable for the timely receipt by the recipient in the event of deliberate or grossly negligent failure of the deadline.
4.4. With regard to any claims of the customer against the mediated service providers, there is no obligation of the agent to advise on the type, scope, amount, prerequisites for claims and deadlines to be observed or other legal provisions.
Section C
Regulations for the brokerage of individual travel services or several travel services that are not related travel services within the meaning of § 651w BGB.
The provisions of this Part C on the brokerage of individual travel services are applicable if the brokered travel service is neither part of a package tour nor part of connected travel services. In this case, no information is required by law for the customer using a form.

Regulations for all types of benefits equally
1. Booking and contract conclusion
1.1. Bookings and the contract concluded with them are legally binding in the respective countries such as Uganda, Rwanda, Tanzania, Kenya. The respective laws and contractual regulations apply.
1.2. Minors can only take part in the trips if they are accompanied by their legal guardians
2. Obligations of the travel agent and the traveller with regard to entry regulations and visas
2.1. If Maurer & Steingruber GbR (Big 5 Africa Tours) takes over the registration in the context of electronic systems for the acquisition of the entry permit for the customer against payment or free of charge as a prerequisite for the entry or transit in certain countries, the following applies: The assumption of this activity is justified without an express agreement No obligation of the travel agent to further inquiries or information about entry or transit formalities or about transit stays on the trip and in particular not to obtain a visa. The customer's attention is drawn to the fact that the electronic entry permit does not replace the final entry permit issued by the border authorities of the respective country.
2.2. Maurer & Steingruber GbR (Big 5 Africa Tours) is not obliged to obtain visas or other documents required for the implementation of the trip without a special, express agreement. If such an order is accepted, Maurer & Steingruber GbR (Big 5 Africa Tours) can demand reimbursement of the expenses incurred, which he was entitled to consider necessary under the circumstances, without express agreement. Maurer & Steingruber GbR (Big 5 Africa Tours) can demand remuneration for its work itself if this has been agreed or, according to the circumstances, the activity was only owed against corresponding remuneration.
2.3. Maurer & Steingruber GbR (Big 5 Africa Tours) is not liable for the issuance of visas and other documents and not for timely access. This does not apply if the circumstances that are decisive for the non-issuance or the delayed access are culpably caused or contributed to by the travel agent.
2.4. The customer is obliged to observe the customs regulations of the country visited as well as those of the home country. The customer is obliged to inform himself about the applicable regulations.
3. Reimbursement of expenses, remuneration, collection, payments
3.1. Maurer & Steingruber GbR (Big 5 Africa Tours) is entitled to demand payments in accordance with the service and payment terms of the mediated service provider, provided that these are effectively agreed between the service provider and the customer and contain legally effective payment terms. Maurer & Steingruber GbR (Big 5 Africa Tours) can assert payment claims against the customer, insofar as this corresponds to the agreements between the agent and the service provider, as his collection agent, but also in its own right on the basis of the customer's statutory advance payment obligation according to § 669 BGB.
3.2. The above regulations apply accordingly to cancellation costs (cancellation fees) and other legally or contractually justified claims of the mediated service provider.
3.3. The customer cannot counter the agent's own payment claims by way of retention or offsetting that the customer has claims against the mediated service provider, in particular due to poor performance of the mediated contract. This does not apply if a culpable breach of contractual obligations on the part of the agent has become the cause or contributory cause for the emergence of such claims or the agent is liable to the customer for the asserted counterclaims for other reasons.
3.4. When the contract is concluded, a deposit of 20% of the travel price is due. Further payments are due on the agreed dates. The remaining travel price is due no later than 30 days prior to departure, provided the voucher has been handed over and the trip can no longer be canceled.
Permits for gorilla and chimp tracking are due immediately and cannot be refunded.
3.5. For bookings made less than 4 weeks before the start of the journey, the entire travel price is due immediately after the contract has been concluded.
3.6. Payments can be made in cash, by bank transfer, by EC card or credit card. We accept VISA and MasterCard. For payments with PayPal, an additional fee of 2.5% of the travel price has to be paid.
3.7. If the customer is partially or completely in arrears with the payment of the travel price, the service providers are entitled to withdraw from the contract and claim damages after a reminder and a deadline

4. Position and obligations of the travel agent in connection with the arrangement of air transport services
4.1. Maurer & Steingruber GbR (Big 5 Africa Tours) is obliged to inform the passenger about the identity of the operating airline when booking. If the operating airline has not yet been determined at the time of booking, the agent will provide him with the information available from the agent about the airline that is likely to operate the flight. If the airline changes, the customer will be informed immediately about the change.
4.2. The respective statutory provisions apply to the contractual relationship between the customer and the airline.
5. Documents about the mediated services
5.1. Both the customer and Maurer & Steingruber GbR (Big 5 Africa Tours) have the duty to provide contractual and other documents of the mediated service provider about the travel services that were given to the customer by Maurer & Steingruber GbR (Big 5 Africa Tours), in particular To check booking confirmations, flight tickets, hotel vouchers, visas, insurance certificates and other documents relating to the travel services arranged for correctness and completeness, in particular for compliance with the booking and the brokerage order.
5.2. Insofar as documents about the brokered travel services are not sent directly to the customer by the brokered service provider, they will be handed over by the travel agent by post or electronic dispatch.
6. The customer's duty to cooperate with the travel agent
6.1. The customer must immediately notify him of any errors or defects in the brokerage activity of Maurer & Steingruber GbR (Big 5 Africa Tours) after they are discovered. This includes, in particular, incorrect or incomplete information about personal customer data, other information, information and documents about the brokered travel services as well as the incomplete execution of brokerage services (e.g. bookings or reservations not made).
6.2. If there is no notification according to No. 6.1 by the customer, the following applies:
a) If the customer does not notify us according to No. 6.1 through no fault of his own, his claims do not lapse.
b) Claims of the customer to Maurer & Steingruber GbR (Big 5 Africa Tours) do not apply to the extent that the customer proves that the customer would not have suffered damage or not in the amount claimed by the customer if the report had been properly reported. This applies in particular if Maurer & Steingruber GbR (Big 5 Africa Tours) proves that an immediate notification by the customer Maurer & Steingruber GbR (Big 5 Africa Tours) enables the possibility of remedying the defect or reducing damage, e.g. through rebooking, additional booking or cancellation.
c) Claims of the customer in the event of failure to report according to No. 6.1 does not apply in the following cases:
• in the event of damage resulting from injury to life, limb or health resulting from an intentional or negligent breach of duty by the travel agent or a legal representative or vicarious agent of the travel agent
• in the case of claims for compensation for other damages based on an intentional or grossly negligent breach of duty by the travel agent or a legal representative or vicarious agent of the travel agent
• in the event of a breach of an essential duty, the fulfillment of which enables the proper execution of the agency contract in the first place or the breach of which endangers the achievement of the purpose of the contract.
The liability for booking errors according to § 651x BGB remains unaffected.
6.3. A contractual and / or legal obligation of the customer to notify the mediated service provider of defects remains unaffected.
6.4. In his own interest, the customer is asked to inform Maurer & Steingruber GbR (Big 5 Africa Tours) about special needs or restrictions with regard to the requested package tour.
7. Important information about insurance
7.1. Maurer & Steingruber GbR (Big 5 Africa Tours) points out the possibility of taking out travel cancellation insurance when booking to minimize a cost risk in the event of cancellation by the customer.
7.2. The customer is also advised that travel cancellation insurance usually does not cover the damage that may arise if the trip is interrupted after the start of the trip, including through no fault of his own. As a rule, travel insurance must be taken out separately.
7.3. Maurer & Steingruber GbR (Big 5 Africa Tours) also recommends that you have adequate foreign health insurance coverage when traveling abroad.
7.4. When arranging travel insurance, the customer is advised that the insurance conditions of the brokered travel insurance may contain special contractual conditions and / or the customer's obligation to cooperate, in particular exclusions of liability (e.g. in the case of previous illnesses), the obligation to cancel the travel cancellation insurance without delay, deadlines for the notification of damage and Deductibles. The agent is not liable if he has not provided any false information regarding the insurance conditions and the mediated travel insurer has a right to refuse performance vis-à-vis the customer on the basis of effectively agreed insurance conditions.
8. Travel agent's liability
8.1. Insofar as Maurer & Steingruber GbR (Big 5 Africa Tours) has not assumed a corresponding contractual obligation by express agreement with the customer, he is not liable for the conclusion of contracts with the service providers to be mediated.
8.2. Maurer & Steingruber GbR (Big 5 Africa Tours) is not liable for defects and damage that the customer incurs in connection with the arranged travel service. This does not apply to an express agreement or assurance from the travel agent, in particular if this deviates significantly from the service provider's description of services.
8.3. Any own liability of the travel agent from § 651x BGB or the culpable violation of travel agent obligations remains unaffected by the above provisions.
9. Consumer Dispute Resolution
Under current law, we are obliged to inform consumers about the existence of the European online dispute resolution platform, which can be used to resolve disputes without having to involve a court. Maurer & Steingruber GbR (Big 5 Africa Tours) does not take part in dispute settlement proceedings of a consumer arbitration board and is not obliged to do so.
10. Change of service / rebooking
10.1. Maurer & Steingruber GbR (Big 5 Africa Tours) undertakes to inform the customer immediately about changes in services and / or deviations in accordance with. To inform § 651f II BGB. In the event of a subsequent, significant change to an essential travel service, the customer is entitled to withdraw from the travel contract or to request participation in an equivalent trip if the tour operator can offer such a trip from its offer at no extra cost. If necessary, the customer will be offered a free rebooking.
10.2. Any warranty claims remain unaffected insofar as the changed services are defective.
10.3. After the conclusion of the contract, the customer is not entitled to changes in terms of the travel date, the travel destination, the place of departure or the accommodation, provided that Maurer & Steingruber GbR (Big 5 Africa Tours) fulfills its pre-contractual information obligations in accordance with. Art. 250 §§ 1-3 EGBGB has fulfilled. If, at the request of the customer, after the conclusion of the contract and up to the 30th day before the start of the journey, changes are to be made to the travel date, the place of departure, the accommodation, the mode of transport or the airline, Maurer & Steingruber GbR (Big 5 Africa Tours) will serve the customer calculate the actual costs incurred per person. In addition, a processing fee of € 25 is agreed.
10.4. Requests for rebooking by the customer that are made from the 29th day before the start of the journey can, if they are carried out at all, only be carried out after withdrawing from the travel contract and re-registering at the same time. This does not apply to requests for rebooking that cause only minor costs.
